The notice requests a signature, not a final outcome. Again, I wasn’t even pulled over by any police officer in any county on 11/27/23, nor did I receive any notice in the mail. The form from the DMV just needs your signature to remove the suspension as it doesn’t require a final outcome. I would like a copy of the citation as well given I was never given one (again, I was never pulled over on that date for anything). Of course I’m pleading not guilty; I wasn’t even pulled over. I just need your signature on the form and I’ll contest the rest in court, however I do need a citation provided to me in any form that validates the time, place etc….which is also a requirement of the law…and if it was the automated system that “caught me”…the law also requires a police officer to be within a certain distance bearing witness to it for a citation to be issued. That didn’t happen either; I was never pulled over. I have been pulled over twice since 10/12, provided my ID and had a cordial conversation (like normal) with the Batavia PD…I decided to give consent to violate my 4th amendment right at that point because he’s a local, and I have family that are police officers and have many ties to the police in the county. The second time, I had time, and reinforced to the officer that even a minor traffic infraction is a crime if it’s enforced on the church (separation of church and state). I don’t know all of your duties as a clerk, but I’m learning. I know you have an oath as well, and information wasn’t provided last time when requested…
I’m just trying to live a peaceful, normal, responsible life. I don’t hate anybody, but I do hold public servants accountable to the law. The New York State constitution is the law of the land of New York, and the United states constitution is the supreme law of the land…making any state law a statuette at best and not law. I also know in the New York State constitution the municipality (local government) always has to favor the rights of the people; hence why it’s part of the city charter which can be revoked if they receive too many complaints of civil rights violations.
I sat down with some of the locals that provided me with food, water, and a sweatshirt when I was kidnapped and falsely arrested last time given I had to camp out in town 46 miles away from home with no way to get anywhere given my phones were still in the impounded rental car…on my birthday…which I don’t celebrate…and given I am a “survivalist”…and former boyscout…I just tried to sleep under a tree and visited the local 7-11 to warm up when I could. The locals seem to think that the local PD don’t have an oath of office. Personally I still think it’s funny, even if my cousin is upset that I didn’t respect the police like I don’t respect my family (facts are facts, and children will be children that don’t like to be scolded…facts over feelings). The love of a saint is unconditional, but love is actions, not mere sentiment. So far the only thing presented again is another crime against me (perjury) as I have no instrument (citation) that was provided.
I like a good challenge; it helps build character.
